1 . Application of Terms and Conditions
In the absence of special stipulations to these conditions and agreed in writing between the parties, all orders placed with the company JEAN -MARIE KOEHLY implies the unconditional acceptance of the terms and conditions below.

Distance selling applies only to shipments within the territory of metropolitan France. In the case of an order outside France, please contact us by phone, mail or email.

2 . Product Presentation
The presentation of the products offered for sale are described on the website: www.vins -koehly.com. The photographs are not contractually binding. Responsibility for the company JEAN-MARIE KOEHLY cannot be held if errors were introduced.

3 . Price determination
Our prices are inclusive of tax (VAT) in Euros Ex-cellar.
It includes the VAT, excise and other taxes.
The company JEAN-MARIE KOEHLY reserves the right to change prices at any time. Naturally, the products ordered are charged at prevailing prices at the time of the order.

Quantity discount: 5% from 96 bottles.
The shipping cost will be applied in addition (see below).

4 . Quote
In the context of sales to professionals (with a valid VAT number), a quotation must first be established for a period of validity determined by us at the date of issuance of the said document. It will be returned by fax (fax no: 03 88 82 70 49) by the buyer, duly authorized, with the words "read and approved" followed by the signature and will have affixed the seal of his company. This acceptance of the order will constitute acceptance of the conditions of sale.

5 . Product availability
The wines featured on our site are offered for sale within the limits of available stocks. In addition, any quality in a vintage that is exhausted will be replaced by an equivalent quality of the next vintage.

6 . Postage
Distance selling applies only to shipments within the territory of metropolitan France. In the case of an order outside France, please contact us by phone, mail or email.

Our prices include VAT to the same address by courier.

Package of 6 to 18 bottles: 22 Euro
Package of 24 to 36 bottles: 25 Euro
From 42 bottles to 200 bottles: 0.50 Euro / bottle
Beyond 200 bottles: free shipping

7 . P ackaging

The wines are packaged in boxes of 6 or 12 bottles (capacity of 50 or 75 cl).
The mix of several references and capacities is possible.

 

8 . Terms of Payment
The price of items ordered is payable as follows: payment for items purchased from the company JEAN-MARIE KOEHLY is payable in full on order. Payment can also be made by credit card (secure online payment) by check payable to JEAN -MARIE KOEHLY or wire transfer. As part of sales to professionals, the price quoted is payable in cash on delivery, a period of additional regulation may be granted by the company JEAN-MARIE KOEHLY, within the limits prescribed by Article L461 -16 of the Commercial Code , which is then written on the quote.

 

9 . Payment methods
• Order online: Secure Regulation Order made by credit card (Blue Card, Visa, Eurocard, Mastercard).
• Order by mail: payment by check or postal order JEAN -MARIE KOEHLY [the order on the screen should be printed and accompany the payment].
All orders must, in order to be processed and shipped, include the exact address of billing, the name and telephone number of contact as well as those of the recipient if the delivery address is different.

If all or part of the delivery address is incorrect thereby forcing the company JEAN -MARIE KOEHLY to return orders into the warehouse, the buyer will bear the consequences and the company JEAN-MARIE KOEHLY shall be entitled to charge for administrative costs and transport associated with the return of orders (ie 30 euros per package).

10 . Shipping / Receiving Control
The company JEAN-MARIE KOEHLY is committed to making every effort to ensure that delivery is effected as soon as possible (generally, the delivery is 7 days from the date of receipt of payment). In case of non receipt of goods within the time specified above, the customer should contact the company JEAN -MARIE KOEHLY who will make every effort to investigate the causes and remedy them.
Upon receipt of the goods by the buyer, it will be necessarily, in case of damaged or missing bottles, to write the reservations specifying the nature and non -compliance on the delivery carriers’ delivery note immediately and inform the company JEAN -MARIE KOEHLY as soon as possible.

11 . Right of withdrawal
Pursuant to the provisions of Article L120-20 of the Consumer Code, the buyer has a period of 7 days from the date of delivery of his order to return the item for exchange or reimbursement at the buyers choice, without penalty except for the return costs which shall be borne by the buyer.

The customer will then inform the company JEAN-MARIE KOEHLY in writing of his decision before returning the goods (letter with acknowledgment of receipt).
Return costs are the responsibility of the buyer. He may return unwanted goods in suitable packaging, the value of wine returned will be refunded within 30 days (excluding initial shipping costs).

12 . Security & Privacy
Personal information collected on -site interface www.vins koehly.com meet our needs and allow us to provide a remote service, we record some of your personal details (name, address, ...). This information is essential for processing and routing of your orders. The information collected is exclusively reserved for internal use.
The files are registered with the CNIL (Commission Nationale Informatique and Freedoms) we observe their strict rules.
Under Articles 38 and following of the Law No. 78-17 of 6 January 1978 relating to computers, files and freedoms, the information may give rise to the right of access to the company JEAN-MARIE KOEHLY.

13 . Protection of Minors
Under Ordinance 59-107 of 7 January 1959, and laws L74 -631 of 5 July 1974 and L91 -32, January 10, 1991, sale of alcohol to minors under 16 is prohibited.
All customers of the c ompany JEAN-MARIE KOEHLY therefore certifies to be 16 years of age or over at the time of order.

14. Warranties
The company JEAN-MARIE KOEHLY is required of the legal guarantee against hidden defects, within the meaning of section 1641 of the Civil Code which provides: "The seller is obliged to guarantee due to latent defects of the thing that make it unsuitable for the purpose of which it was intended, or that decrease this use that the buyer would not have gained, or would have a lower price if he had known. "
Consequently, the buyer has up to 2 months (from date of delivery) to send the complaint to the company KOEHLY JEAN-MARIE. Beyond this period, the company JEAN-MARIE KOEHLY can no longer guarantee the wine, since no control over the quality of the storage (element essential to the preservation of wine) may be made or the buyer must provide the evidence that the alteration of the wine was prior to the sale.
To enable the company JEAN-MARIE KOEHLY to appraise the wine itself, the buyer is asked to kindly leave the wine at the company’s disposal; the company JEAN-MARIE KOEHLY will organize the pickup at its expense. If the problem is with 1 or 2 bottles, the buyer will be refunded the value of the defect wine. If more than two bottles, the refund will be made by cheque .
• Moreover, the company JEAN-MARIE KOEHLY agrees to cancel the order at the request of the client, and a full refund in the event of non compliance with the terms of delivery and within the guarantee "satisfied or refunded" except in cases of force majeure to the company JEAN-MARIE KOEHLY or its carriers.
• In case of breakage of the products ordered, followed by a rupture of stock, the company JEAN-MARIE KOEHLY will offer the buyer a product of equal or superior quality without the conditions of sale being changed (particularly in terms of price).
• We advise you to check your packages in the presence of the deliveryman. If you see a package missing or damaged you must make reservations on the delivery note. If it is broken, you can refuse the package.

15 . Jurisdiction clause and applicable law
The parties accept this contract in French law.
All disputes concerning the interpretation and execution of this contract will be the exclusive jurisdiction of the courts of the Tribunal de Grande Instance of Strasbourg.

Alcohol abuse is dangerous for health . It is important to consume in moderation .
